Terms & Conditions - General Information
As a user of this website on behalf of the business you represent (referred to as "you/your/the purchaser"), you acknowledge that any use of this website, including any transactions you make ("use/using"), is subject to the terms and conditions outlined below.
We reserve the right to change or update these terms and conditions at any time. All sales are final, and no returns or credits will be allowed for previously undiscovered defects or discrepancies in descriptions.
1. Trade Sales
All goods sold on this site are classified as 'trade sales.' As a customer purchasing via this site, you are not covered by legislation that protects 'non-trade' consumers, regardless of the grade of parcel sold. All merchandise is sold without any form of warranty or guarantee, and full liability for any future issues with the merchandise rests with the purchaser, not BrandBrothers. Ensure you read and understand all the terms, conditions, and grades of stock prior to making a purchase. Compensation will not be provided if products develop faults after resale or during future use. Stock is sold as a 'parcel,' and although we strive to ensure accuracy, overages and shortages on pallets may occur. Refunds for missing items are not provided.
(a) End of Catalogue / Clearance Stock
This is surplus end-of-range stock believed to be in good condition but may have soiled or damaged packaging and normal manufacturing defects. No warranty or guarantee, whether expressed or implied, is attached to any goods sold.
(b) Customer Return Stock
This comprises merchandise returned to the SOURCE COMPANY* as faulty or defective, which cannot be returned to the original manufacturer, or merchandise that has suffered accidental damage within the SOURCE COMPANY’S distribution system. The merchandise may be damaged or simply have damaged packaging. It may include incomplete items where one or more components are missing. Generally, this category will include damaged and used stock. No guarantee as to the breakdown of damaged stock, whether expressed or implied by law, will attach to any such sale.
(i) You must remove the name of any source company or associated firm/company or any trademark belonging to such firms from the merchandise or mark it in accordance with BrandBrothers' instructions before resale. (ii) No catalogue or promotional literature belonging to any source company or its associated firms may be used in any way in connection with the resale of the merchandise. (iii) All merchandise sold to you is sold without guarantee as to fitness for purpose, with the understanding that the purchaser will ensure the goods are made safe and serviceable before resale. No warranty, whether expressed or implied by law, will attach to any such sale. It is the purchaser's prerogative to inspect the merchandise offered for sale. BrandBrothers assumes that such an inspection has been made. Arrangements to inspect can be made with appropriate warehouse staff. (iv) The purchaser will indemnify BrandBrothers from any claims resulting directly or indirectly from the resale of the merchandise by the purchaser. (v) No returns will be accepted, and no credit will be allowed for previously undiscovered defects or discrepancies in description or quoted quantities. (vi) No statement made by any person regarding the quality or condition of any merchandise on offer is to be relied upon for the purpose of making an offer to purchase. (vii) All stock is sold “ex warehouse.” Any customer returning goods to any retail outlet of a SOURCE COMPANY to obtain a full refund will be liable for criminal prosecution by the SOURCE COMPANY.
2. Safety Tests
Merchandise is sold on the basis that it is repaired or reconditioned as necessary prior to resale. Safety tests complying with current legislation to CE standards required by law must be carried out on merchandise, and any remedial work completed and PAT tested before it is offered for resale.
3. Title
The title to each of the items or goods covered by this invoice is not legally transferred until complete payment has been made to BrandBrothers. A source company is defined as the company originally retailing stock to the general public.
4. Removal of Catalogue Numbers
It is a standard requirement that all traders adhere to the rules and regulations laid out below. These rules form an addition to our standard Terms & Conditions as outlined on our Invoice. All catalogue numbers or markings must be either crossed out with a permanent marker or obliterated from all cartons before resale. No catalogue or promotional literature from any catalogue or high street store may be used in connection with the resale of any item or be visible in public places where stocks are sold by the trader or anyone acting on their behalf. The original SOURCE COMPANIES' names or associated companies must not be used in any form in connection with the resale of stock.

Returns Policy
By using this website, you confirm that you are doing so in the course of business and not as a consumer and have the authority to bind any business on whose behalf you use this website.
No returns will be accepted, and no credit will be allowed for previously undiscovered defects or discrepancies in description. This policy does not affect any statutory rights you may have, to the extent that such rights are not excluded or limited under these terms and conditions.
